What is it?

If you disagree with a decision made by the municipality, you can object within 6 weeks.

How does it work?

  • The municipality's decision will tell you whether you can object. It will also tell you what address to send your objection to.
  • Your appeal must reach the municipality within 6 weeks. This period begins on the day after the date the decision was sent to you.
  • The municipality may ask you to come by to discuss your objection.

What to do.

The decision itself usually indicates whether you can file an objection and the address to which you can send your objection. You can submit your objection digitally or in writing.

Online objection

As an interested party in a decision, you can submit a notice of objection digitally (see arrange directly). You will need to use DigiD. Read more information about DigiD here. You fill in the digital objection form. Clearly state why you disagree with the decision. You can also submit the objection as the authorized representative of an interested party. If you are not registered as a lawyer, you must submit an authorization showing that you are acting on behalf of the interested party. This written authorization must bear the signature of the person representing you.

You can also file an objection (in writing) as a company.

Procedure

If you object digitally, the procedure is identical to the written procedure, as described below.

Written procedure

You send a letter to the administrative body from which you received the decision. In it you clearly state why you disagree with the decision.

Term

A notice of objection must be filed within six weeks after the decision is announced. If you object after those six weeks, the administrative body may declare your objection "inadmissible. This means that the administrative body will not consider your objection. The 6-week period begins the day after the municipality announced the decision. This date can be found in the letter itself or in the publication of the municipal section Aalten Actueel in the door-to-door newspaper Aaltens Nieuws.

Objection handling

Receipt

The objection is registered and the objector receives a confirmation of receipt, which, among other things, mentions the probable date of the hearing of the Objections Committee in which the objection will be dealt with. As a rule, the Independent Appeals Commission holds its hearing on the last Wednesday of the month.

Admissibility

The secretary of the Objections Committee reviews the objection for admissibility.

Hearing

The invitation to the hearing will follow no later than 2 weeks in advance. The hearing can -depending on the nature of the objection- take place in public or in private. The agenda is published in the municipal section Aalten Actueel and on the municipal website.

Elaboration

The secretary of the Appeals Committee sends the report of the hearing and the committee's advice to the administrative body. Based on this advice, the administrative body in question will take a reconsideration decision, of which the objector will be informed in writing. This reconsideration decision will be accompanied by the advice of the Objections Committee. If the handling period of 12 weeks threatens to be exceeded, this period can be extended by the administrative body with a maximum of 6 weeks.

Appeal to the court

From the first day after publication of the decision on the objection, you have 6 weeks to file a notice of appeal. The announcement is usually the date on which the decision was sent by the municipality. If you are too late with your appeal, your appeal will, in principle, no longer be dealt with.

Court treatment

The court sends a copy of your notice of appeal to the municipality. The municipality is given a chance to write a response (statement of defense). The court sends you a copy of this statement of defense. Often, but certainly not always, a judge will hear your appeal in court (hearing). The municipality will also be invited to this. During this hearing you will have the opportunity to explain your appeal and answer questions from the judge.

How long does it take?
