Laying cables and pipes in public land
What is it?
With new construction or substantial remodeling, take into account cabling (for telecommunications, gas, electricity). You must request these separately from the relevant suppliers. You will need an environmental permit to install overhead cables and pipes.
You may only lay cables and pipes in the ground in public areas. You must first report this to the Land Registry.
If you want to place cables and pipes above ground, you need an environmental permit.
What to do.
You make your notification to the Land Registry. When doing so, please provide the following information:
- a description of the work
- a schedule of all work
- the planned start date and duration of the work
- the type of cable or pipe to be laid
- The number of cables or pipes to be laid
- data where the cable or pipeline will be laid (route)
In certain situations, reporting is not enough:
- If you are placing new hazardous materials pipelines on a new route, ask that the zoning plan be amended.
- If you are placing new hazardous materials pipelines on an existing route, apply for an environmental permit.
- If you are placing cables or pipes above ground, you will need an environmental permit. You can apply for this through the Omgevingsloket online.
Overhead piping
An environmental permit is required for the installation of above-ground infrastructure works. You can submit an application in the Omgevingsloket online.
Underground pipes
- The construction of underground works in public areas requires the consent of the municipality.
- You can submit a request through MOOR ( Meldpunt Opbrekingen Openbare Ruimte). The municipality assesses the plans and grants approval
- If necessary, further consultation will take place
What do I need?
In MOOR, you will be asked to enter the following information, among others
- a description of the work
- A phased planning of all work
- the planned start date and duration of the work
- data on the type of cable or pipe to be laid
- The number of cables or pipes to be laid
- data where the cable or pipeline will be laid (route)
What does it cost?
The rate (2024) amounts to €555.60 for regular work and €110.90 for work of a less far-reaching nature for processing a notification in connection with obtaining permission regarding the time, place and method of carrying out work as referred to in the General Ordinance on Underground Infrastructure.
The rate (2025) is €567.80 for regular work and €113.30 for work of a less far-reaching nature for the processing of a notification in connection with obtaining permission regarding the time, place and method of carrying out work as referred to in the General Ordinance on Underground Infrastructure.
Additional information
Municipality's authority in public grid
If the cable or pipe to be laid is part of a public network, the municipality must allow the cable or pipe to be buried. The laying of a cable cannot be refused. However, the municipality must coordinate the work. All matters relating to the laying of cables and pipes are laid down in the A.V.O.I. (General Regulation on Underground Infrastructure) of the municipality of Aalten 2012. The General Requirements UNOG (Uniformity Network Operators Eastern Gelderland) apply to the execution of the work. The cable or pipe owner is obliged to bear the costs of repair work to, for example, the street paving.
Municipality's authority in other cases
If the cable to be laid is not part of a public network, the municipality is not obliged to tolerate it. In that case, the municipality's cooperation is not mandatory and the municipality may Requirements (financial) Requirements on its cooperation.
