Water permit
What is it?
You need a water permit for certain activities involving groundwater and (in or on) surface water.
Surface water is water in:
- locks
- pee
- ponds
- channels
- lakes
- streams
- rivers
Do you, as a private individual or company, carry out activities in or on surface water or with groundwater? If so, you may need a water permit. Sometimes a notification is sufficient.
What to do.
- Check via Vergunningcheck whether you need a water permit for your activities or whether you only need to submit a notification.
- Apply for the permit via Omgevingsloket. Do this at least 8 weeks before you want to start the work. For complex applications, submit your application at least 6 months in advance.
- In your application for a water permit, you must indicate:
- at which location you wish to carry out the activities;
- what these activities entail;
- why you want to carry out the activities and what impact they will have on the environment;
- the period during which you need the permit.
- You can also submit the application or notification to the municipality where you wish to carry out the activities.
Preliminary consultation
It is best to consult with the municipality or the competent authority in advance. Preliminary consultation can make it easier to assess your permit application. You will find out exactly what you need a water permit for and what Requirements . Which authority is competent depends on your intended activities and the location. Competent authorities are:
- the water board (for a regional water system and small industrial groundwater extractions/infiltrations)
- Rijkswaterstaat (for the main water system)
- the province (for large-scale industrial groundwater extraction/infiltration)
- Inspectorate for Transport, Public Works and Water Management (for Rijkswaterstaat's own projects)
Apply for a water permit
You can submit an application digitally via the Omgevingsloket (Environment Desk) . You can also report water issues via the Omgevingsloket. As a private individual, you will need a DigiD login code. As a company, you will need eHerkenning.
Lodge an objection or submit an opinion
Do you disagree with the decision on your permit application? In the short procedure, you can immediately lodge an objection with the competent authority. Submit your objection within 6 weeks of the decision being announced.
In the long procedure, a draft decision on your permit application is first drawn up. This is the draft decision. The competent authority makes this draft decision on the water permit available for inspection. Anyone can submit their opinion on this within six weeks of the draft decision being made available for inspection. Explain in your opinion why you disagree with the decision. These opinions will be taken into account in the final decision.
Lodge an appeal
After the six-week period during which the draft decision is available for inspection, the decision will be taken. Interested parties may appeal against this decision to the court within six weeks of its publication. In this lengthy procedure, interested parties can only lodge an appeal if they have also submitted their views on the draft decision in good time or can demonstrate that they were reasonably unable to do so. There may be several interested parties who can lodge an appeal with the court.
If you disagree with the court's ruling, you can appeal to the Administrative Law Division of the Council of State.

How long does it take?
For example, you need a water permit for:
- the construction of a jetty;
- the removal of groundwater;
- the discharge of wastewater or waste substances into surface water;
- the sealing of water, such as the filling of a ditch;
- the construction of a water storage area for the temporary collection of (rain)water;
- building on, near, or in the vicinity of a dike, pumping station, or water storage area;
- organizing an event on the water.
