Business content of the prior agreement for the 't Walfort recreation area in Aalten as referred to in Article 6.24 of the Spatial Planning Act (Wro)

The mayor and aldermen of the municipality of Aalten hereby announce, pursuant to Article 6.2.12 of the Spatial Planning Decree, that they have entered into an anterior agreement. This agreement concerns land exploitation as referred to in Article 6.24 of the Spatial Planning Act.

Business description

The agreement was concluded with the initiator due to the initiator's intention to redevelop the 't Walfort recreation area into a high-quality recreation park with a maximum of 116 recreational homes.  To make this possible, a modification plan will be adopted pursuant to Article 3.6(1)(a) of the Spatial Planning Act (Wro). The development will take place in accordance with the internal planning authority as included in the current zoning plan 'Landelijk gebied 2015' (Rural Area 2015). The development will take place within the framework of a landscape integration and green setting. The prior agreement is a voluntary agreement with the initiator (and owner) with the aim of making agreements about the redevelopment of the recreation area.

Business content

Below is a brief summary of the business content of the agreement:

  • The initiator is responsible for drawing up the amendment plan with all associated studies;
  • The municipality undertakes to make every effort to initiate the amendment procedure and adopt the amendment plan;
  • The initiator undertakes to contribute to the costs incurred by the municipality in connection with administrative and advisory costs;
  • The initiator is responsible for preparing the operating area for construction and habitation;
  • Any planning damage shall be borne by the initiator.

Operating area

The operating area covered by the agreement is the same as the area covered by the amendment plan and coincides with the former 't Walfort recreation park. It includes the cadastral parcels of the municipality of Aalten, section P, nos. 162, 166, and 1321.

Access

This business description of the content of the agreement will be available for inspection at the municipal office at Hofstraat in Aalten for six weeks from Thursday, December 20, 2023, in accordance with the provisions of Article 6.2.12 of the Spatial Planning Decree.
