What local exceptions apply in the municipality of Aalten?
Under the Quality Assurance Act (Wkb), the municipality can establish local deviations for specific situations. These are local situations whereby the end result of a construction activity may not meet the building regulations. The quality assurance officer must be aware of these special local circumstances. The quality assurance contractor must incorporate them into the assurance plan and risk assessment.
1. Groundwater protection areas ('t Loohuis, Corle and Dinxperlo
The groundwater protection areas 't Loohuis, Corle, and Dinxperlo are located within the municipality of Aalten .
The Gelderland Environmental Regulation (effective from May 1, 2024) includes rules regarding Groundwater Protection Areas. Examples include groundwater extraction, geothermal energy systems, geothermal energy, boreholes, ground disturbances, and structures. As a result, there may be specific circumstances that affect the construction plan in terms of its technical feasibility. Take this into account in the risk assessment.
The Environmental Plan contains restrictive rules for these areas (Article 40.3 environmental zone - groundwater protection area). These can be consulted at omgevingswet.
2. Ground heat interference zone
Geothermal energy systems that are installed close to each other can affect the temperature of the subsoil near the 'neighboring systems'. As a result, geothermal energy systems that are installed close to each other (+/-150 m) can have a positive or negative influence on each other. Soil energy systems are not allowed in groundwater protection areas ('t Loohuis, Corle and Dinxperlo).
3. Carrying capacity of soil
Through probing, you conduct your own investigation into the bearing capacity of the soil. This research may show that:
- There is a need to dig deeper. Then take into account in the groundwater protection areas 't Loohuis, Corle and Dinxperlo the rules that apply to them (see for this the Omgevingsverordening Gelderland of the province and article 40.3 environmental zone - groundwater protection area in the Omgevingsplan).
- You must perform excavation work in an archaeologically valuable area. There are rules for this in the environmental plan. If archaeological values are found, the structure may have to be founded in a different way. Include this in the local risk assessment.
4. Building near monument or dilapidated building
For construction work near a monument, a dilapidated building, or a building that is poorly founded, additional measures should be taken in advance that reduce the risk of vibration damage occurring.
5. High-voltage pylons

The Environmental Plan contains rules on this subject. This is referred to as: "Pipeline - High-voltage connection." In principle, no sensitive objects may be constructed there. Under Requirements with an environmental permit, for which advice must be sought from the pipeline operator. This may also mean that additional structural measures must be taken.
6. Noise, facade soundproofing
The cumulative noise (noise from different noise sources together) on the facade of noise-sensitive buildings may not exceed the standard value or an established higher (limit) value for (replacement) new construction.
7. Building near surface water
When building near surface water managed by the water board, a notification must also be made to the water board. Information on how to make a notification or apply for a permit can be found on the Rijn and IJssel Water Board website .
8. Well drilling
If it is necessary to apply source irrigation for construction, this must be reported to the water board. In some cases, a permit must also be applied for. Information on how to report or apply for a permit can be found on the Rijn and IJssel Water Board website . Discharging well water is only allowed to surface water and not to the sewerage system. If discharging into the on-site sewer is the only option, then this must be reported to the municipality.
9. Foundation adjacent
Specific foundation structures of adjacent buildings that may affect the foundation of a structure to be built must be considered.
10. Building near environmentally harmful buildings/objects.
If construction takes place near environmentally harmful buildings/objects, there may be implications for building and/or plant facilities.
11. Building near gas lines
When carrying Requirements construction work in the vicinity of a gas pipeline, additional (structural) measures may need to be taken. Rules for this are included in the environmental plan, see designation: "Pipeline – Gas." In principle, no sensitive objects may be constructed there. Under Requirements with an environmental permit, for which advice must be sought from the pipeline operator (Gasunie).
12. Building near mills
When carrying out construction work in the vicinity of windmills, additional structural measures may need to be taken. Rules on this are included in the environmental plan, see designations: "safety zone - windmill biotope 1" and "safety zone - windmill biotope 2." In principle, openness must be maintained in order to ensure that the windmill can catch the wind freely. Requirements under Requirements with an environmental permit. 14. Mandatory infiltration of stormwater
Rainwater infiltration
Considering efficiency and what the municipality can expect from individuals and businesses, the municipality assumes that in new construction and in demolition and reconstruction, rainwater itself is collected and infiltrated into the soil. This is an obligation.
For small developments in the outlying area, an on-site infiltration facility must be constructed with a static capacity of at least 55 mm of rainwater per m2 of paved surface (roofs and pavement, provided the pavement already drains onto your property).
For large developments in the countryside and within the built-up area, an infiltration facility must be constructed on your own property with a static capacity of at least 80 mm of rainwater per m2 of paved surface (roofs and paving, provided the paving already drains onto your property). You should note that rainwater coming from driveways may not be drained towards public land but should be connected to your own infiltration facility.
It may happen that during heavy rainfall the rainwater cannot be stored by the infiltration facility within the own property boundaries. In this case, excess water may be discharged above ground to the public area using an overflow facility (equipped with a leaf trap or relief pit).
15. Demolition, asbestos removal, or debris crushing on site.
If demolition, asbestos removal or debris breaking is taking place in addition to construction work, the Omgevingsdienst regio Achterhoek (ODA) must be contacted in advance.
16. Construction and demolition safety
The National Construction and Demolition Safety Guideline must be taken into account. This guideline concerns construction and demolition safety in relation to the project's surroundings. This therefore concerns safety outside the construction fence for people and adjacent properties. Safety during construction, focused on construction workers and other people present on the construction site, is regulated by the Working Conditions Act.
